(Oral) Learned counsel for the parties fairly state that appeal against the acquittal in case under Section 138 of the Negotiable Instruments Act, lies before learned Sessions, Judge, Rampur, under Section 372 CrPC. 2. In view of the above, as prayed, appellant herein is permitted to withdraw the present appeal with liberty to file afresh before appropriate court of law. Needless to say, plea of limitation shall not be raised by the opposite party on account of the fact that inadvertently, appellant herein had chosen wrong forum.
