Date : 13.02.2026. Heard Mr. A. Paul, learned counsel for the petitioner. Also heard Ms. A. Begum, learned Additional Public Prosecutor, Assam appearing on behalf of the State respondent. Page No.# 2/3 This is an application under Section 483 of BNSS, 2023 praying for grant of bail to the accused petitioner, namely, Rajesh Boro @ Dewa who was arrested in connection with Mukalmua P.S. Case No. 209/2015, under Sections 329(1)/296/117(1)/109(1) of the BNS, 2023. Scan copy of the TCR has already been received and perused the same. From the submission of Mr. Paul, the learned counsel for the accused petitioner as well as from the record it reveals that the present accused petitioner is granted with interim bail on 26.09.2025 by this Court and it is also reflected from the order dated 22.01.2026 that during the pendency of this bail petition, the charge sheet was submitted. Considering this aspect of the case, this Court called for the scan copy of the TCR which has been received. From the record, it is seen that the next date for appearance of the accused is fixed on 27.03.2026, after filing of the charge sheet. The case is not yet committed by the learned Court below. Mr. A. Paul, the learned counsel for the petitioner submitted that the petitioner is ready and willing to contest the case by appearing before the learned Trial Court on each and every date, fixed by the Court. Ms. A. Begum, the learned Additional Public Prosecutor, Assam in this regard that there are some materials in the case diary but it is a fact that the case has already been charge sheeted and the present petitioner is on interim vide order dated 26.09.2025.
Page No.# 3/3 Considering the submissions made by the learned counsel for both sides and considering the interim bail granted earlier to the present petitioner, the earlier interim bail dated 26.09.2025 is hereby made absolute with the same terms and conditions. However, the petitioner is directed to appear before the learned Trial Court on each and every date, to be fixed by the Court and to abide by all terms and conditions. With the above terms and conditions, this bail petition stands allowed and disposed of. JUDGE Comparing Assistant
