Learned counsel namely Sri Mukkannappa S.B., for complainant who is on record, but represented by learned counsel Sri S.Rajesh and wherein the said counsel in this matter submits that though the compliance affidavit has been filed by the respondent / accused dated 17.03.025, but the absolute compliance has not been made in pursuance of the order passed by the learned Single Judge on the writ side. 3. Whereas learned counsel Sri K.S. Bheemaiah for respondent / accused, has filed a Memo of even date seeking to produce Pension Payment Order along with annexures and - 3 - NC: 2025:KHC:10886-DB CCC No. 735 of 2023 the same is taken on record. Learned counsel has taken us through the Pension Payment Order dated 06.03.2025, wherein, the details of pension as set out in PART - I of the said order rendered by the competent authority reads as under:- 1) Pension 2) Gratuity 3) Family Pension 4) Commutation of Pension 5) Leave Encashment 6) Transport Allowance 7) Medical Allowance / Facilities 8) General Provident Fund (GPF) - GPF Facility not provided 9) General Group Insurance - Group Insurance Scheme not provided 10) Life Certificate 4. This report has been submitted by learned counsel for respondent / accused and moreso, the relief has been granted by the learned Single Judge on the writ side and the same has been complied. Therefore, it does not arise for taking action against the respondent, keeping in view Section 2(b) of the Contempt of Courts Act, 1971. - 4 - NC: 2025:KHC:10886-DB CCC No. 735 of 2023 5. Therefore, keeping in view the compliance report submitted by the respondent / accused and keeping in view the provision of Section 2(b) of the Contempt of Courts Act, 1971, this contempt proceeding does not survive for consideration and consequently, the contempt proceedings are hereby dropped. In the meanwhile, learned counsel for the complainant seeking some liberty. However, liberty as sought for is granted in accordance with law.
