GP FOR HOME 2 The Court made the following: ORDER: This Writ Petition is filed under Article 226 of Constitution of India with the following prayer for: “.... a Writ of Mandamus declaring the high-handed action of the 3rd Respondent in interfering with the petitioners by repeatedly summoning them to the police station under the guise of investigation in FIR No.323 of 2025, without their being named as accused, as illegal, arbitrary, high-handed, and violative of the fundamental rights guaranteed to the petitioners under Articles 14, 21 of the Constitution of India, with a consequential direction to the Respondents to not threaten and interfere with the petitioners by calling them to the Police Station except in accordance with law.” 2. Sri G.Arun Showri, learned counsel for the Petitioners would submit that the Petitioners being relatives of Accused No.1 in Crime No.323 of 2025 of Sarpavaram Police Station, Kakinada, they are called to the Police Station though they have no connection with the alleged crime. 3. Sri V.Farooq, learned Assistant Government Pleader for Home would submit that the presence of the Petitioners is not required and hence, they are not called to the Police Station. It is further submitted that the Petitioners are not shown as Accused by this date, however, investigation is in progress. 4. Considering the submissions made, the Writ Petition is disposed of. However, Police are directed to follow due process of law. There shall be no order as to costs.
