Heard the learned counsel appearing for the parties. 3. FIR in Crime No.79/2025 was registered by K.M.Doddi Police Station, Mandya District for the aforesaid offences against the petitioner and another, on the basis of first information dated 18.04.2025 received from Sri Krishna, Police Officer, attached to K.M. Doddi, Police Station. During the course of investigation, the petitioner herein was arrested on 19.04.2025 and subsequently remanded to judicial custody. 4. The bail application filed by the petitioner before the jurisdictional Sessions Court in - 3 - HC-KAR NC: 2025:KHC:22737 CRL.P No. 8178 of 2025 Crl.Misc.No.335/2025 was dismissed on 27.05.2025. Therefore, he is before this Court. 5. The material on record would go to show that UDR Case No.8/2025 was registered after a complaint was received from Smt. Asha W/o late R. K. Ashwath, who is the mother of deceased Shrunga alleging that her daughter Shrunga, who was pursuing her Diploma Course in Civil Engineering in Bharathi Education Trust Polytechnic College, K. M. Doddi within the jurisdiction of K. M. Doddi Police Station, Mandya, had committed suicide by hanging herself in her hostel room on 19.03.2025 at about 12.30 p.m. She has stated that accused Nos.1 and 2 named in the FIR who were studying in the very same college, had teased and fought with her daughter and as a result, her daughter had committed suicide. During the course of investigation in the aforesaid UDR case, Investigation Officer had recorded the statement of other students who were studying in the College and thereafter, FIR has been registered against the accused for the aforesaid offences. - 4 - HC-KAR NC: 2025:KHC:22737 CRL.P No. 8178 of 2025 Either in the complaint submitted by the mother of the deceased or in the first information submitted by the Investigation Officer, there is no mention of any such incident committed by accused persons immediately prior to Shrunga committing suicide which would have either abetted or instigated her to commit suicide. Except stating that petitioner and another, who are also students of the same College in which Shrunga was studying had teased and fought with her, there is no other allegation found against accused in the present case. Petitioner aged about 21 years is a student and is in custody from 19.04.2025. Under the circumstances, I am of the opinion that his prayer for grant of regular bail needs to be answered affirmatively. 6. Accordingly, the following: ORDER Criminal Petition is allowed. - 5 - HC-KAR NC: 2025:KHC:22737 CRL.P No. 8178 of 2025 The petitioner is directed to be enlarged on bail in Crime No.79/2025 registered by K.M.Doddi Police Station, Mandya District, for the offences punishable under Sections 108, 115(2) R/w 3(5) of BNS, 2023, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000 (Rupees One Lakh only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE NMS
