--- 08/24.07.2025 Heard the parties. This application has filed for quashing of order dated 07.06.2023 and 09.10.2023 passed by Ms. Rupam Smriti Topno, learned JMFC, Bermo at Tenughat in connection with Bokaro Thermal P.S. Case No.123 of 2018, corresponding to G.R. No. 992 of 2018 (S), whereby and wherein, the learned Magistrate has directed for issuance of process under Sections 82 and 83 of the Cr.P.C. It was submitted that the petitioners are resident of Gujarat. However, from the order directing issuance of process under Sections 82 & 83 of the Cr.P.C., it appears that the warrant of arrest was issued against the petitioners at the address at Patna. It was further submitted that as the petitioners have got no connection with the address, on which, warrant of arrest and process under Section 82 of the Cr.P.C. was issued. They had no information that they are wanted in this case. Mr. Naveen Kumar Ganjhu, learned A.P.P. after going through the record conceded these facts. Accordingly, the order dated 07.06.2023 and 09.10.2023 passed by Ms. Rupam Smriti Topno, learned JMFC, Bermo at Tenughat, directing issuance of process under Sections 82 and 83 of the Cr. P.C. in connection with Bokaro Thermal P.S. Case No.123 of 2018, corresponding to G.R. No. 992 of 2018 (S) are quashed. This Cr. M.P. is allowed.
Pending I.A., if any, stands also disposed of.
