1. Heard Mr. J. C. Gogoi, learned counsel for the petitioner. Also heard Mr. R. R. kaushik, learned Additional Public Prosecutor and Ms. N. Begum,
learned counsel for the informant.
2. This petition under Section 482 BNSS is filed for granting the
Page No.# 2/3 privilege of pre-arrest bail to the petitioner, namely, Amulya Saikia, apprehending arrest in connection with North Lakhimpur P.S. Case No. 394/2025 registered u/s 118 (2)/109 (1) of BNS.
3. The allegation as contained in the FIR lodged by the victim Sri. Surajit Sharma (Baba) with the allegation that on 18.11.2025 at about 5.20 PM, the accused suddenly attacked her brother from behind with an intention to kill as a result of which he sustained grevious injuries and that after the incident, the accused filed away from the place of occurrence but was apprehended by the local people.
4. Earlier bail petition of the petitioner was rejected by this court on 17.12.2025 in BA No. 3884/2025.
5. Ms. N. Begum, learned counsel for the informant submits that she has filed an affidavit, copy of which has been annexed with the bail petition. She further submits that she has no objection to grant of bail to the petitioner.
6. Mr. R. R. Kaushik, learned Additional Public Prosecutor submits that in the meantime, investigation has also been completed, resulting in a charge-sheet.
7. In these circumstances, the interim pre-arrest bail granted vide
order, dated 05.01.2026 is hereby made absolute, subject to the following conditions- (i) That the petitioner shall be available for the trial if one commences; (ii) He shall not hamper or tamper with evidence.

8. This disposes of the anticipatory bail application.
