JUSTICE SUDESH BANSAL Order 03/09/2025 1. Two accused-petitioners have preferred instant criminal miscellaneous petition under Section 482 Cr.P.C., impugning the order dated 01.08.2022, taking cognizance for offences under Sections 148, 149, 308, 323, 324, 325 & 341 of IPC along with other accused persons, namely, Kalu Meena, Magan Singh Meena and Amar Singh Meena, whereagainst revision petition was filed, which too has been dismissed on merits vide order dated 23.09.2022. 2. Having heard the counsel for petitioner and from perusal of the record, it is apparent that the complainant-victim has levelled specific allegation against both the parties to pelt stones and cause injuries and relying upon that, cognizance has been taken [2025:RJ-JP:35250] (2 of 2) [CRLMP-151/2023] against the petitioners, which has been affirmed by the Revisional Court. 3. The instant criminal miscellaneous petition is virtually in form of second criminal revision petition which is expressly barred under Section 397(2) of Cr.P.C. 4.
