District & Sessions Judge, Bengaluru Rural District arising out of Crime No.300/2024 registered by Thalaghattapura Police Station, Bengaluru City for the offences punishable under Sections 75, 308(2), 351(2) of BNS, 2023 and Section 67(A) of the Information Technology Act, 2000 is before this Court seeking regular bail. 2. Heard the learned counsel appearing for the parties. 3. FIR in Crime No.300/2024 was registered by Thalaghattapura Police Station, Bengaluru City for the aforesaid offences against the petitioner herein, on the basis of first information dated 03.08.2024 received from the victim lady, aged about 34 years. During the course of investigation, the petitioner herein was arrested on 03.08.2024 and subsequently remanded to judicial custody. Investigation in the case is completed and charge sheet has been filed against the petitioner for the aforesaid offences. - 3 - HC-KAR NC: 2025:KHC:25067 CRL.P No. 8141 of 2025 4. The bail application filed by the petitioner before the jurisdiction Sessions Court in S.C.No.301/2024 was dismissed on 28.01.2025. Therefore, he is before this Court. 5. Perusal of the material on record would go to show that, the first informant, who is a married lady has alleged that she got acquainted with the petitioner in the year 2016 and in the year 2017, he allegedly asked sexual favour from her. It is also alleged that the petitioner allegedly asked the victim lady to make video call to him and show her nude body. It is further alleged that, without her knowledge he had recorded the nude video of the victim lady and thereafter he was threatening of circulating the nude video recorded by him. It is further alleged that, the victim lady had thereafter transferred a sum of Rs.80,000/- to the bank account of the petitioner. The petitioner has been arrested in the present case on 03.08.2024 and ever since then he is in custody. 6. Investigation of the case is complete and charge sheet has been filed. Even according to the victim lady, she is acquainted to the petitioner from the year 2016 and sexual harassment alleged by the victim lady relates to the year 2017 - 4 - HC-KAR NC: 2025:KHC:25067 CRL.P No. 8141 of 2025 . The maximum punishment for the alleged offences is imprisonment for a period of seven years. It is not in dispute that the petitioner has no criminal antecedents. Trial in the case is yet to commence. Under these circumstances, I am of the opinion that, the prayer made by the petitioner for grant of regular bail needs to be answered affirmatively. 7. Accordingly, the following: ORDER Criminal Petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.301/2024 pending before the Court of VI Addl. District & Sessions Judge, Bengaluru Rural District arising out of Crime No.300/2024 registered by Thalaghattapura Police Station, Bengaluru City for the offences punishable under Sections 75, 308(2) and 351(2) of BNS, 2023 and Section 67(A) of the Information Technology Act, 2000, subject to the following conditions: a) The petitioner shall execute a personal bond for a sum of Rs.1,00,000 (Rupees One Lakh - 5 - HC-KAR NC: 2025:KHC:25067 CRL.P No. 8141 of 2025 only) with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; c) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; d) The petitioner shall not involve in similar offences in future; Sd/- (S VISHWAJITH SHETTY) JUDGE NMS
