3. This Criminal Misc. Application has been filed by the applicant, challenging the order dated 12.04.2016 passed by learned Judicial Magistrate, Ranikhet, District Almora in Criminal Misc. Application No. 29 of 2015, Rajendra Singh Rana and Others Vs. Gokul Singh Rana. Applicant has also challenged the order dated 28.06.2016 passed by Sessions Judge, Almora, District Almora in Criminal Revision No. 25 of 2016, Rajendra Singh Vs. State of Uttarakhand and Others.
4. Earlier applicant filed an application under Section 156(3) Cr.P.C. against respondent no.
2. Learned Judicial Magistrate, Ranikhet rejected the said application vide order dated 12.04.2016. Against the said order, applicant filed Criminal Revision. The said criminal revision has also been dismissed by learned Sessions Judge, Almora, District Almora vide order dated 28.06.2016. Hence, this criminal misc. application.
5. Perusal of the impugned orders passed by learned Magistrate reveals that he has considered & discussed all relevant aspects. Thus, the view taken by the learned
Magistrate, cannot be faulted. Learned Revisional Court was thus justified in dismissing the Revision Petition. Thus, this Court does not find any reason to interfere with the impugned orders.
6. Accordingly, the criminal misc. application fails and is dismissed.
