Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) of Bihar Prohibition and Excise Act. 3 . It is alleged that 4 liters country made liquor was recovered from spot and petitioner is alleged to have fled away from the spot. 4. It is submitted that the petitioner is innocent and has falsely been implicated in this case on the basis of suspicion . No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery . Petitioner has got no Patna High Court CR. MISC. No.21348 of 2025(2) dt.23-04-2025 2/2 criminal antecedent of similar nature . 5 . Learned counsel for the State opposes the bail petition . 6. Considering the fact that no incriminating material has been recovered from conscious possession of this petitioner and other circumstances of case , in the event of arrest/surrender within eight weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional sessions Judge – VII cum- special Judge Excise II Madhepura in connection with Excise Police Station Case No. 200 of 2020-21 , subject to the conditions laid down under section 482 ( 2 ) of the Bharatiya Nagarik Suraksha Sanhita ( BNSS) , 2023 .
