IN THE HIGH COURT OF JHARKHAND AT RANCHI B.A. No. 10229 of 2024 Yogesh Kumar Agarwal, S/o Rajendra Prasad Agarwal, age-35 years, R/o 70, Harmu Road, Shivganj, P.O.- G.P.O., P.S.- Kotwali, District- Ranchi … Petitioner -Versus - The State of Jharkhand … Opp. Party ------ CORAM: - HON’BLE MR. JUSTICE AMBUJ NATH ----- For the Petitioner : Mr. Aman Dayal Singh, Advocate For the State : Mr. Abhay Kumar Tiwari, A.P.P. --- 04/27.01.2025 Heard the parties. Petitioner has been made an accused in connection with Cyber P.S. Case No. 152 of 2024, for the offences under Sections 419, 420, 467, 468, 471, 120B of the Indian Penal Code and Sections 66(B), 66(C), 66(D) of the I.T. Act, pending in the Court of Sri Manish Ranjan, learned A.J.C.II-cum-Special Judge, Cyber Crimes, Ranchi. The petitioner is member of international cybercrime syndicate, whose tentacles are spread up to China. The syndicate had formed a WhatsApp group. They used to lure unsuspecting persons to join their WhatsApp group on the promise that if they invested money with their firm, they would get good return as their money will be invested in share market. On the basis of confession of co-accused persons, this petitioner was apprehended and his mobile phone was seized. From perusal the case diary, it appears that he was in constant touch with cyber criminals in China. It further appears from his chat that huge amount of money was transferred to China, so that the same could not be seized by the law agencies here in India. It appears from the case diary that the petitioner operated several bank accounts in which money of the victims were transferred and from these accounts, it was transferred to China. Considering the aforesaid facts, I am not inclined to release the petitioner, on bail. Accordingly, his prayer for bail stands rejected. (Ambuj Nath, J.) Jay/-
