JUSTICE MAULIK J.SHELAT Date : 11/06/2025 ORAL ORDER 1. Heard learned advocate Mr.Sehbazhusan A. Kadri for the applicant. 2. After arguing for some time, under the instruction of his client, he does not press the present application. 3. Nonetheless, learned advocate Mr.Kadri would submit that applicant is a housewife not earning anything and fully dependent upon the parents, thereby, he may be permitted to file an appropriate application seeking travelling expenses and / or maintenance from the opponent – husband in the Family Suit filed by the husband before Family Court Vadodara. 4. Permission as sought for is granted. 5. It is open for the applicant to file necessary application seeking a relief of travelling expenses and / or C/MCA/1336/2025 ORDER DATED: 11/06/2025 maintenance as the case may be. 6. The Family Court is hereby requested to decide such application first before entering into the merits of the matter by giving opportunity of hearing to all the parties concerned. 7. If such an application will be decided in favour of applicant and opponent commits three consecutive default in a row, i.e., not paying travelling / maintenance amount to applicant, liberty is reserved in favour of applicant to file an application for transfer of the proceeding from Family Court, Vadodara to Family Court, Nadiad. 8. It is made clear that this Court has neither gone into nor examined the merits of the matter. 9. With the aforesaid observation, direction and having accepted the request made by learned advocate Mr.Kadri, the present application is disposed of as withdrawn. No order as to costs.
