Bora, learned counsel for the applicant who by this Interlocutory application filed in connected MACApp. No. 372/2025 is seeking a direction to the Registry of this Court for receiving 50% of the total awarded compensation deposited by the appellant/insurance company in terms of the order of this Court on 29.08.2025 in I.A. (Civil)/2701/2024. Mr. S.K. Goswami, learned counsel for the insurance company submits that the applicant can be allowed to withdraw the 50% of the deposited amount, subject to a bond, as the involvement of the vehicle in the alleged accident Page No.# 3/3 is disputed. Considering the above, as the amount has already been deposited before the Registry, the applicant herein, who is the awardee – may be allowed to receive the amount, subject to making of the bond regarding the same and proper identification and other usual formalities.
