JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner seeks for the following reliefs: “Wherefore, it is humbly prayed that this Hon’ble Court be pleased to set aside/modify the order passed by the learned IX Additional Session Judge, Bengaluru Rural District, Bengaluru dated 10.01.2025 on Application under Section 430 of BNSS in Crl.A.No.88/2024 by extending the time to deposit the fine amount of 20%, in the interest of justice.” 2. Heard learned counsel for the petitioner and learned counsel for the respondent and perused the material on record. 3. On 16.06.2025, this Court passed the following order: “Learned counsel for the petitioner submits that 20% of the fine amount as directed by the Appellate Court in Crl.A. No.88/2024 dated 10.01.2025 would be deposited by the petitioner before the Appellate Court on or before 02.07.2025 in C.C.No.6770/2019. The said submission is placed on record. Re-list on 04.07.2025. - 3 - HC-KAR NC: 2025:KHC:24203 CRL.P No. 8101 of 2025 Issue emergent notice to the respondent returnable by 04.07.2025. In addition, petitioner is permitted to serve learned counsel appearing for the respondent before the Trial Court.” 4. As per the aforesaid order passed by this Court, petitioner has deposited 20% of the fine amount on 02.07.2025 before the Trial Court and that the petitioner has no objection for the respondent to withdraw the said amount. 5. The aforesaid submission is placed on record. 6. Learned counsel for the respondent submits that the bail in Crl.A.No.88/2024 may be directed to be disposed of by the Appellate Court in the stipulated time frame. 7. In view of the aforesaid submissions and facts and circumstances of the case, I deem it just and appropriate to dispose of the petition by issuing certain directions. 8. In the result, I proceed to pass the following: ORDER i) The petition is hereby disposed of. - 4 - HC-KAR NC: 2025:KHC:24203 CRL.P No. 8101 of 2025 ii) Respondent is permitted to withdraw the amount deposited by the petitioner before the Trial Court in C.C.No.6770/2019. iii) Registry of the Trial Court is directed to disburse/release the aforesaid amount deposited by the petitioner in favour of the respondent immediately forthwith without any delay. iv) The Appellate Court before whom Crl.A.No.88/2024 is pending is directed to dispose of the appeal within a period of three months from the next date of hearing.
