Neutral Citation No. - 2025:AHC:36520-DB Court No. - 29 Case :- SPECIAL APPEAL No. - 144 of 2025 Appellant :- Vinod Mishra Respondent :- State Of Uttar Pradesh And 5 Others Counsel for Appellant :- Deepak Kumar Pandey,Mukesh Kumar Pandey Counsel for Respondent :- C.S.C. Hon'ble Ashwani Kumar Mishra,J. Hon'ble Donadi Ramesh,J. Heard learned counsel for the parties. The petitioner's challenge to the order of the transfer has been rejected by the learned Single Judge on the ground that transfer is an exigency of service and no employee has a vested right to continue at the same place.
Learned counsel for the appellant states that the appellant is left with less than 2 years to retire and, therefore, he be allowed to remain in the same district. Reliance is also placed upon the transfer policy. On a pointed query of the Court, learned counsel for the petitioner informs that ever since his employment in 1984, the petitioner has been continuing in district Mirzapur. He has been transferred to Bhadohi which is a adjoining district. In view of the fact that the petitioner otherwise holds a transferable post and he has been shifted only to an adjoining district, we are not persuaded to interfere in the order of transfer. It is however provided that in the event the petitioner joins pursuant to the order of transfer it shall be open for him to make representation which shall be accorded consideration in accordance with law. Subject to the above modification, the present special appeal is consigned to records.
