Virender Singh, Judge (oral) By way of present petition, indulgence of this Court has been sought to quash the order dated 20.11.2024, passed by the Court of learned Chief Judicial Magistrate, Kangra at Dharamshala, H.P. (hereinafter referred to as ‘the trial Court’).

2. Vide order dated 20.11.2024, proceedings under Section 82 Cr. P.C. were ordered to be initiated against the petitioner. It has fairly been conceded by
learned counsel for the petitioner that in pursuance of the proceedings, so initiated, the petitioner has been declared as Proclaimed Offender.

Learned counsel for the petitioner has confined his prayer to the extent that he may kindly be permitted to surrender before the learned trial Court by moving an appropriate application, and till decision of the application, no coercive action be taken against him.

Considering the said fact, the present petition is allowed with a direction to the petitioner to move an appropriate application, before the learned trial Court, within a period of seven days from today. The learned trial Court is requested not to take any coercive action against the petitioner, till decision of the application.
5. With these observations, the present petition is
