The petitioner has been made accused in connection with Spl. POCSO Case No.34 of 2024 arising out of Senha P.S. Case No. 117 of 2022, for the offences registered under Sections 363, 366(A) of the I.P.C. and cognizance has been taken under Sections 363, 366A, 376(2)(n) of the I.P.C. and Section 6 of the POCSO Act, pending in the Court of learned Additional Sessions Judge-I-cum-Spl. Judge, POCSO, Lohardaga. Petitioner is alleged to have enticed away 16 years old victim to leave her lawful guardianship. She was taken to various places. The statement of the victim has been recorded under Section 164 Cr.P.C., in which she stated that the petitioner has also established physical relationship with her. The victim is aged about 16 years, her consent for physical relationship is immaterial. In view of the aforesaid facts, I am not inclined to release the petitioner, on bail.
