Mr. Bratin Suin, Adv. …for appellant (item no.10)/ Respondent (item no.11) 2 The Court : Instructions in the form of an e-mail (printout) are handed over to the Court by the learned Advocate representing the Eastern Coalfields Limited. The instructions read as follows : “In connection to the trail mail this is to inform you that the competent authority of ECL has agreed for payment of MMCC (without interest) as per the mutual consent by both the parties from the date of death of the ex- employee until she attains 60 years of age. Accordingly Medical examination for assessment of her age is also to be done this week.” The learned Advocate for the writ petitioner submits that he has instructions to accept the MMCC in terms of the written instructions handed over to the Court today by the Eastern Coalfields Limited. Since the parties are ad idem with respect to the claim in terms of the instructions extracted above, nothing survives in these appeals and pendency of the same will serve no useful purpose. The appeals along with the applications are disposed of accordingly. It is expected that the Eastern Coalfields Limited will proceed expeditiously to ensure that the admissible amounts are paid as per the above noted instructions, in accordance with law.
