1. This contempt application has been filed alleging willful and deliberate disobedience of the order and direction dated 20th February, 2025 passed in WPA(P) 22 of 2025. 2. The applicant would contend that in spite of the direction issued by this Court to the Officer-in- Charge, South Port Police Station to lock the wheels of the illegally parked vehicles, impose heavy fine and maintain strict vigil, action has not been taken by the police. Several difficulties faced on account of illegal parking have been highlighted in the contempt application. 3. Mr. Chatterjee, learned advocate appearing for the alleged contemner has produced a copy of the
2 written instruction given by the Officer-in-Charge, South Port Police Station dated 26.08.2025 wherein it is stated that in compliance of the order passed by this Court police has taken sustained measures to prevent illegal parking within its jurisdiction. Regular patrolling and checking are being carried out to identify vehicles parked in violation of the rules. In those cases, the wheels of such vehicles have been locked, compelling the owners to approach the police authorities for release, after which appropriate fines and legal action have been imposed as per law. Furthermore, it is stated that beat meetings are being conducted by the officers on a regular basis, where local residents, shopkeepers are made aware that illegal parking not only disrupt normal vehicular movement but also obstruct the movement of emergency services such as ambulances, fire brigades etc. Further, it is stated that during these meetings, awareness is created about the provisions of law relating to illegal parking, the penalties prescribed, and the consequences of repeated violations. Furthermore, it is stated that police have undertaken sensitization drives using loud speaker along Bhukailash Road and other congested areas and
3 warn that strict enforcement action would be taken against violators. Deployment of police personnel at vulnerable points has been made to maintain constant vigil and ensure smooth traffic flow.
Further, it is stated that joint drive is also made with the traffic department of Kolkata Police for stricter enforcement and immediate response to complaints of illegal parking. Proper signage has also been installed at critical locations by the traffic department of Kolkata Police to discourage illegal parking. Further, it is stated that Bhukailash Road and other adjoining areas under South Port Police Station jurisdiction are densely populated, so, local people temporarily parked their vehicles but long- term parking is strictly prohibited. This police station remains vigilant and proactive in addressing the grievances of citizens and ensuring smooth traffic movement in the mentioned areas. Constant monitoring and rapid response are prioritized to minimize inconvenience to both residents and commuters. The written instruction filed in Court today be kept on record. 4. Thus, from the report it is seen that action has been taken pursuant to the directions issued by this Court which, according to the petitioner, is
4 satisfactory. In order curb illegal parking long term-sustained effort is required to be taken by the concerned police station. The concerned police station may involve NGOs for sensitizing the people, discourage them from illegal parking on both sides of roads which would cause immense hardship to the commuters as wells travelling public. In our view, the matter would be monitored by a superior officer in the rank of Deputy Commissioner of Police, Traffic Department, who was the third respondent in the writ petition. Accordingly, the Deputy Commissioner of Police, Traffic Department, Lalbazar is directed to ensure that sustained efforts are to be taken to prevent illegal parking. 5.
