Learned counsel for the petitioner contends that the petitioner has been falsely involved in the present case as the signatures of the petitioner did not match with the alleged withdrawl forms. He further contends that the petitioner was wrongly arrested in the present case on 10.04.2024 and after completion of investigation, the final report under Section 173 Cr.P.C. has already been presented before the competent Court. CRM-M-10870-2025 -3- submits that four more FIRs were also ordered to be registered against the petitioner on similar allegations, however, the petitioner has filed a petition bearing Number CRM-M-33323-2024 before this Court for clubbing of the FIRs against him. Even the prosecution has been able to examine only 01 witness, out of total 28 witnesses so far and the conclusion of the trial may take quite a long time.
4. On the other hand, learned State counsel has vehemently opposed the submissions made by learned counsel for the petitioner on the ground that four more FIRs have been ordered to be registered against the petitioner and being a habitual offender, he is not entitled to be released on bail by this Court. Even, he has cheated several innocent investors to the tune of lacs of rupees in the present case.
5. I have heard the learned counsel for the parties and perused the record.
6. In the present case, even though serious allegations have been levelled against the petitioner, however, the petitioner is in custody for the last more than 01 year and 01 months. The prosecution has been able to examine only 01 witness, out of total 28 witnesses, so far. Thus, there is no likelihood to early conclusion of the trial.
