It is submitted that the 5**^ respondent’s land properly adjoins the petitioner’s land and that the 5'*^ respondent has encroached upon the petitioner’s land. 2. The learned Standing Counsel appearing for the respondent Nos. 2 and 3 submits that the representation was not considered as it had no application under the prescribed proforma and there was non-payment of the requisite fee for conducting the survey: therefore, the 2"'^ respondent has not acted any further. 3. Recording the submissions, it is left open for the petitioner to submit a fresh representation/application in the prescribed format and pay the requisite fee. Upon submission of the said form and payment of the requisite fee, respondent Nos. 2 and 3 shall duly conduct the survey by issuing notice to ail concerned and furnish a copy of the report to the petitioner. 4. Accordingly, this Writ Petition is disposed off. There shall be no order as to 5. costs. As a sequel, miscellaneous petitions pending, if any, shall stand closed.
