Mr.Manoj Chauhan, Additional Advocate General, for the respondents. Civil Revision No. 125 of 2010 Mr. Manoj Chauhan, Additional Advocate General, for the petitioner. Respondent is stated to have expired. CMP(M) No. 165 of 2025 in CR No. 110 of 2018 This application has been filed for substitution of deceased petitioner Subhash Chand through his sons namely Rattan Chand and Jagdev Chand. Despite granting opportunities, no reply has been filed by respondents/State till date. Copy of death certificate and copy of Will dated 18.11.2005 have been placed on record to claim that applicants Rattan Chand and Jagdev Chand are only eligible legal heirs to be brought on record in substitution of deceased Subhash Chand. Though copy of Will has been placed on record, however, there are two other natural legal heirs i.e. wife and daughter namely Bimla Devi and Sunita Devi respectively of deceased Subhash Chand. But they have not come forward for their impleadment. However, it is also a matter of record that nothing has been placed on record to substantiate that Will has been accepted by
other legal heirs of deceased Subhash Chand. Will was registered in the year 2005. Taking into consideration the material placed before me, without adjudicating the inter-se rights of natural legal heirs of deceased Subhash Chand, only for the purpose of continuation of present proceedings Rattan Chand and Jagdev Chand are permitted to substitute deceased petitioner Subhash Chand as petitioners No.1(a) and 1(b) respectively. Needless to say that dispute amongst the natural legal heirs of deceased Subhash Chand, if any arises, has to be decided amongst them in appropriate proceedings by the competent Authority but not in this petition. Application is allowed in aforesaid terms and disposed of. Civil Revision No. 110 of 2018 Amended memo of parties be filed within one week. List for hearing on 21st July, 2025. Civil Revision No. 125 of 2019 It is apt to record that respondent Subhash Chand in present petition was petitioner in Civil Revision No. 110 of 2018 wherein he has been substituted through his sons Rattan Chand and Jagdev Chand.
But in present petition, no steps have been taken by the State for substitution of deceased respondent Subhash Chand. On persuasive request made by learned Additional Advocate General, further two weeks’ time is granted to take
