Heard the parties.
The petitioner has been made accused in connection with Bharno P.S. Case No. 41 of 2024, for the offences registered under Sections 303(2), 317(5) & 3(5) of B.N.S., 2023, pending in the court of Mrs. Nirmala Barla, learned Judicial Magistrate, 1st class, Gumla.
It is alleged that in the wee hours of 31.07.2024, unknown persons on a Bolero vehicle bearing registration No. JH01FF-6977 had attempted to commit theft in the premises of the informant.
It was submitted that petitioner is not named in the F.I.R. and his name has come in the confession of co-accused. It was further submitted that similarly situated co-accused Mohammad Rijwan and Md. Shahnawaz @ Mohammad Shahnawaz have been granted bail by this Court.
Learned A.P.P on behalf of the State has opposed the prayer for bail but does not dispute the aforesaid fact.
In view of the submission made above, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of Mrs. Nirmala Barla, learned Judicial Magistrate, 1st class, Gumla, or her successor, in connection with Bharno P.S. Case No. 41 of 2024.
