The petitioner has been made accused in connection with S.T. Case No.36 of 2024, arising out of Karmatanr P.S. Case No. 132 of 2023, for the offences registered under Section 302 of the I.P.C., pending in the Court of learned Principal Sessions Judge, Jamtara. On 26.12.2023 at about 5:00 P.M., there was some altercation between the petitioner and his cousin Dharan Pujahar as cattle of this petitioner grazed the bean plant of Dharan Pujahar. The petitioner assaulted Dharan Pujahar by a brick, due to which he succumbed to his injuries. It was submitted that there was no premeditation on the part of the petitioner to assault the deceased. It was further submitted that even assuming the police case to be true, no case under Section 103(1) of the B.N.S. will be made out, rather the case under Section 105 of the B.N.S. will be made out. In view of the submissions made above, I am inclined to enlarge the petitioner on bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bonds of Rs. 20,000/- (Rupees twenty thousand) with two sureties of the like amount each, to the satisfaction of learned Principal Sessions Judge, Jamtara, in connection with S.T.
