NARENDRA PRASAD ORAL ORDER This writ petition is filed by defendant Nos. 2, 3 and 4 under Article 227 of the Constitution of India, challenging the order dated 17.10.2022, whereby the IV Additional Civil Judge and JMFC, Davanagere dismissed IA No.III filed under Order VI Rule 17 of CPC in O.S.No.458/2019. - 4 - NC: 2025:KHC:6595 WP No. 16022 of 2023 2. The plaintiff filed a suit for easementary right. On service of summons, defendants filed the written statement. On the basis of the pleadings of the parties, the trial court framed an issue. When the matter was posted for evidence, the defendant No.2 filed an application for amendment of the written statement. On going through the application, it appears that it will not change the nature of the suit and the defendants are not withdrawing any admission made in the written statement. If the said application is allowed, it will not cause any prejudice to the plaintiff. Therefore, the trial court has erred in dismissing the application. 3. Accordingly, the following order is passed: (i) The writ petition is allowed. (ii) The order dated 17.10.2022 passed on IA No.III in O.S.No.458/2019 by the IV Additional Civil Judge and JMFC, Davanagere is set aside. - 5 - NC: 2025:KHC:6595 WP No. 16022 of 2023 (iii) IA No.III filed under Order VI Rule 17 of CPC is allowed.
