The opp. party no. 2 is ready and willing to take the petitioner to his house to resume the conjugal life but the petitioner refuses to go with the opp. party no. 2. This criminal miscellaneous petition has been filed with the prayer to quash the order dated 08.02.2022 passed in ABA No. 9037 of 2021 to cancel the bail granted to the opp. party no. 2 herein. It has been contented in the petition that since the opp. party no. 2 herein is not taking the petitioner herein to her matrimonial house, the bail granted to the opp. party no. 2 herein be cancelled. Keeping in view the fact that the opp. party no. 2 is ready and willing to take the petitioner to his house to resume conjugal life, this Court is of the considered view that there is no justifiable reason to cancel the bail granted to the opp. party no. 2 herein.
