After arguing for some time and keeping in view that it has been brought to our notice that the present appellant’s locus-standi was questioned on the issue of Quo Warranto by the learned Single Judge; and the fact that there was an injunction order passed against him in OMP No.574 of 2019 in COMS No.20 of 2019, titled as Dr. Rachna Gupta vs. Dev Ashish Bhattacharya, on 03.01.2020, which was also upheld by the Division Bench in LPA No.18 of 2020 with certain modifications, wherein he was restrained from publishing the material against the

- 2 - applicant-plaintiff therein on social media. Similarly, there was an FIR No.48 of 2023, dated 03.05.2023, under Sections 354-D, 506 and 509 of the Indian Penal Code, registered against the appellant at Police Station East Shimla, Himachal Pradesh and the interim order of protection, as such, was vacated by the Apex Court in Special Leave to Appeal (Crl.) No(s).13502/2023, on 22nd March, 2024 and he was given liberty to approach this Court for regular bail on account of the fact that further comments were posted by him on the Facebook. Thus, we were inclined to impose costs as the issue pertains to writ of Quo Warranto and nothing tangible has been demonstrated to show us that eligibility condition of the private respondent was not fulfilled, who is the Vice- Chancellor of a Central University then counsel for the appellant has chosen to withdraw the present appeal.
Accordingly, the instant appeal is dismissed as withdrawn along with pending application(s), if any.
