3. Petitioner was serving as Teacher, who completed the age of superannuation on 31.08.2016. He sought benefit of Government Policy, which provides that Teachers retiring during mid academic session would be permitted to continue till the end of session. His request was rejected. Thus, feeling aggrieved, petitioner filed this writ petition in the year 2016, seeking the following reliefs:-
“I. a writ, order or direction in the nature of certiorari call for the record of the case and quash the order dated 12-7-2016 contained in Annexure no 6 to the writ petition. II. a writ, order or direction in the nature of mandamus directing the respondents to permit the petitioner continue till the end of the academic session i.e. 31 March 2017. III. a writ, order or direction in the nature of mandamus directing the respondent to 3 to forward the matter of the petitioner for granting reappointment till End of the academic session before the appointing authority of the petitioner. IV. a writ, order or direction in the nature of mandamus, which this Hon'ble court may deem fit and proper on the basis of the facts and circumstances of the case.
4. Learned State Counsel submits that the writ petition has become infructuous as petitioner has retired long back, and the benefit of extension in terms of Government Policy cannot be given to him at this belated stage.
5. This Court finds substance in the submission made by learned State Counsel that after nearly nine years, benefit of extension in service from the date of retirement, petitioner cannot be given benefit of extension of service. The writ petition, therefore, dismissed as infructuous.
