Heard Mr. Shailendra Kumar Bajpai, learned counsel for the petitioner. Also heard Mr. Khulesh Sahu, learned Panel Lawyer for the State/respondent/s as well as Mr. Sandeep Dubey with Mr. Manas Vajpai, Advocates for the respondent No.3. 2. By way of this writ petition, the petitioner has prayed for following reliefs: “10.1. That, this Hon'ble Court may kindly be pleased to call for the entire records in relates to the case of the petitioner from the possession of respondents for its kind perusal. 10.2 That, this Hon'ble Court may kindly be pleased to issue a writ/order/direction, directing the respondent that not to demolish the house of the petitioner. 10.3 That, the Hon'ble Court may kindly be pleased to direct the respondent to consider the case of the petitioner for grant of "patta" as per exiting scheme of the government. 10.4 That, this Hon'ble Court may kindly be pleased to grant any other relief/relief's in favour of the petitioner, which the Hon'ble Court deemed fit & just in the facts and circumstances of the case.. An affidavit in support of this petition is filed herewith.” 3. Learned counsel for the petitioner submits that the petitioner is residing in house in question, though the land belong to the State, but the petitioner is seeking grant of patta/lease in his favour which is pending before the authority concerned. 4. Learned counsel for the respondents submits that subject to due verification and scrutiny of the claim of the petitioner, appropriate steps shall be taken at the earliest within a period of 45 days. 3 5. Given the statement made by the counsel for the respondents, the writ petition at this juncture stands disposed of directing the petitioner to file an appropriate representation along with the copy of this order within 10 days before the respondent authorities raising his grievances, as the petitioner is seeking grant of patta/lease in his favour which is pending for adjudication before the authority concerned and in turn the authorities concerned i.e. the Collector, Raipur is directed to consider the application as filed by the petitioner along with the earlier applications filed by the petitioner for grant of patta/lease within a outer limit of 45 days. 6. It is made clear that this Court has not expressed any thing on merits and the respondents may consider the case of the petitioner on its own merits. 7.
