------ For the Petitioners : Mr. Diwakar Upadhyay, Advocate For the Respondents : Ms. Nirupama, A.C to Sr. S.C.-II …...... 02 /28.01.2025: The petitioners in this writ application have prayed for a direction upon the State to create 156 posts of Assistant Sub Inspector of Police in Jharkhand Armed Police including J.A.P.- 08 on the ground that there is huge shortage of post of Assistant Sub Inspector. Further a prayer has been made to promote the petitioners to the post of Assistant Sub Inspector after creation of the said posts. 2. Whether the State wants to create a post or not is within the exclusive domain of the State. High Court cannot interfere and enter into such domain, while exercising jurisdiction under Article 226. The Hon’ble Supreme Court in the case of Union of India & Ors. versus Ilmo Devi & Anr. reported in (2021) 20 SCC 290 has held that creating or sanctioning posts is the sole prerogative of the Government and the High Court in exercise of the power under Article 226 of the Constitution cannot issue mandamus or direct to create or sanction posts. 3. Thus, the prayer made before by this Court cannot be entertained and the relief sought for cannot be granted exercising jurisdiction under Article 226 of the Constitution. 4.
