Criminal Miscellaneous Bail Application No. 10554/2024 Indra Bai W/o Omprakash, Aged About 32 Years, R/o Osav, Police Station Raipur District Jhalawar. (Petitioner At Present Confined In District Jail, Jhalawar). ----Petitioner Versus State Of Rajasthan, Through PP ----Respondent For Petitioner(s) : Mr. Timan Singh For Respondent(s) : Mr. N.S. Dhakar, PP HON'BLE MR. JUSTICE ANIL KUMAR UPMAN Order 13/01/2025
1. The instant bail application has been filed under Section 483 of BNSS, on behalf of the petitioner, who has been arrested in connection with FIR No.115/2024 registered at Police Station Raipur (Jhalawar), District Jhalawar (Raj.) for the offence punishable under Section 302 of IPC. Later on, police filed charge- sheet in this matter. 2. It is contended by learned counsel for the petitioner that the accused-petitioner has falsely been implicated in this case. It is submitted that petitioner is daughter-in-law of the deceased and she lodged a criminal case of molestation against the deceased and on that basis, she has been roped in this case. It is submitted that there is no eye-witness of the incident. The petitioner is in custody since 19.05.2024 and trial will take considerable time in its conclusion. Further custody of the petitioner would not serve any fruitful purpose. [2025:RJ-JP:16318] (2 of 2) [CRLMB-10554/2024]
3. Per contra, learned Public Prosecutor opposes the bail application. It is submitted that the petitioner murdered her father-in-law, with axe blows and same has been recovered in pursuance of the information given by the petitioner. The petitioner was having previous enmity with the deceased. It is also submitted that husband of the petitioner namely Omprakash in his statement recorded under Section 161 Cr.P.C. has stated that when he went to his home, the petitioner met her and she told him that the deceased came to her home and caught her hold from behind upon which she gave beatings to him resulting in his death. Learned Public Prosecutor thus submits that there is clear evidence available on record pointing towards guilt of the accused petitioner. It is thus contended that looking to the gravity of offence and seriousness of allegation attributed to the petitioner, the petitioner does not deserve indulgence of bail. 4.
Having regard to the totality of the facts and circumstances of the case and considering the arguments advanced by learned counsel for the petitioner as well as learned Public Prosecutor; and the statement of Omprakash, who is husband of the petitioner, recorded under Section 161 Cr.P.C. as also looking to the gravity of offence and nature of allegation attributed to the accused petitioner, I am not inclined to grant bail to the accused-petitioner. Accordingly, this bail application stands dismissed. (ANIL KUMAR UPMAN),J LALIT MOHAN /60
