JUSTICE S VISHWAJITH SHETTY ORAL ORDER 1. Accused no.2 in S.C.No.60/2025 pending before the Court of II Addl. District & Sessions Judge, Mandya, arising out of Crime No.50/2022 registered by Shivalli Police Station, Mandya District, for the offences punishable under Sections 399, 402 IPC and Sections 3 & 25 of Arms Act, 1959, is before this Court under Section 439 Cr.PC seeking regular bail. 2. Heard the learned Counsel for the parties. 3. Perusal of the material on record would go to show that petitioner was arrested in the present case on 10.07.2022 and was subsequently produced before the Trial Court and remanded to judicial custody. He was thereafter enlarged on bail by the jurisdictional Sessions Court in Crl. Misc. No.791/2022 disposed of on 29.08.2022. For the reason that petitioner had not appeared before the jurisdictional court in S.C.No.60/2025 on regular dates of hearing, coercive steps - 3 - HC-KAR NC: 2025:KHC:23760 CRL.P No. 8050 of 2025 were taken against him and his presence was secured on 04.04.2025 and on the said date, he was remanded to judicial custody. 4. Learned Counsel for the petitioner, on instructions, has submitted that in all the other criminal cases registered against him, petitioner is already enlarged on bail. So far as the present case is concerned, on the merits of the case he was earlier granted bail by the jurisdictional Sessions Court in Crl. Misc. No.791/2022 disposed of on 29.08.2022. 5. For the mistake committed by the petitioner by not appearing before the court on regular dates of hearing, he has been sufficiently punished. Considering the antecedents of the petitioner, appropriate conditions are required to be imposed on him while enlarging him on bail. Accordingly, the following order: 6. The petition is allowed. The petitioner is directed to be enlarged on bail in S.C.No.60/2025 pending before the Court of II Addl. District & Sessions Judge, Mandya, arising out of Crime No.50/2022 registered by Shivalli Police Station, Mandya - 4 - HC-KAR NC: 2025:KHC:23760 CRL.P No. 8050 of 2025 District, for the offences punishable under Sections 399, 402 IPC and Sections 3 & 25 of Arms Act, 1959, subject to the following conditions: a) Petitioner shall execute personal bond for a sum of Rs.1,00,000/- with two sureties for the likesum, to the satisfaction of the jurisdictional Court; b) The petitioner shall appear before the Station House Officer of Shivalli Police Station, Mandya District, and mark his attendance on every first Sunday between 10.00 a.m. and 01.00 p.m., regularly for a period of one year from the date of this order; c) The petitioner shall appear regularly on all the dates of hearing before the Trial Court unless the Trial Court exempts his appearance for valid reasons; d) The petitioner shall not directly or indirectly threaten or tamper with the prosecution witnesses; e) The petitioner shall not involve in similar offences in future; - 5 - HC-KAR NC: 2025:KHC:23760 CRL.P No. 8050 of 2025 f) The petitioner shall not leave the jurisdiction of the Trial Court without permission of the said Court until the case registered against him is disposed off.
