2. Writ Petition (M/S) No. 1245 of 2024, filed by petitioner was disposed of with a direction to the Appellate Authority/ Commissioner, Garhwal Division to consider and decide petitioner’s appeal against suspension of his fair price shop, within six weeks.
3. Alleging disobedience of the said order, this contempt petition has been filed. Learned State Counsel was asked to get instructions.
4. Learned State Counsel submits that District Magistrate, Haridwar had passed the suspension order and the same person who passed the order as District Magistrate is now holding the position of Commissioner, Garhwal Division, therefore, he cannot decide the appeal against his own order and he has written a letter to the State Government to depute some other officer for deciding the Appeal.
5. The difficulty faced by Commissioner, Garhwal Division, appears to be bona fide,
2025:UHC:2045 therefore, contempt petition is disposed by requesting the Secretary, Food and Civil Supply, to nominate some other officer, not below the rank of Additional Secretary, to take decision on petitioner’s appeal.
6. This Court hopes and expects that the officer so nominated by the State Government will take decision on petitioner’s appeal within four weeks from date of receipt of certified copy of this order.
7. Learned State Counsel undertakes to communicate this order to the Secretary, Department of Food and Civil Supply by Monday i.e. 24.03.2025.
8. With the aforesaid observation, the contempt petition stands disposed of.
