ORDER:
This Writ Petition is filed under Article 226 of the Constitution of India for the following relief:
“….to issue a Writ, Order or direction more particularly one in the nature of Writ of Mandamus declaring the actions of the Respondent police officials in interfering with the peaceful possession of the Petitioners over the Subject Property as illegal, arbitrary, contrary to law, unconstitutional and consequently direct the Respondent police officials to not to interfere with the peaceful possession of the Petitioners over the Subject Property and act in accordance with the law while dealing with the criminal complaints and pass…”
2. Heard Sri Dandugula Satya Siva Darshan, learned counsel for the writ petitioners and learned Assistant Government Pleader for Home. 3. Learned Assistant Government Pleader for Home on written instructions would submit that the Station House Officer, Gara Police Station, visited Ampolu village, calling some persons and found that the family members of the writ petitioners and his relative Gondu Kameswara Rao, S/o.Appalanaidu are having disputes with regard to the land located in the village.
They approached Civil Court and filed application for injunction and G.Kameswara Rao approached Revenue Officials and Police Officials. At that time, police visited the village to conduct preliminary enquiry, and then the petitioners approached this
4 Court and filed the writ petition alleging that the police are interfering in civil matters. He would further submit that the dispute in the case is civil in nature, and they will not interfere in the matter. 4. In the light of submissions made by the learned Assistant Government Pleader which would disclose that the impugned dispute is of civil in nature, police will not interfere in such matters. 5. This Court is of the considered opinion that nothing remains for further adjudication, and the writ petition can be closed at the stage of admission, without going into merits of the case. 6. Accordingly, the Writ Petition is closed. There shall be no order as to costs.
