Order 10/01/2025
1. Though number of grounds have been urged to assail the
order of the learned Single Judge, taking into consideration that the foundational reason for passing the order against the appellant was that he was allotted the subject land in violation of Rule 21B of the Rajasthan Colonisation (Chambal Project Government Lands Allotment and Sale) Rules, 1957, ignoring the preferential right of the holder of the adjacent plot and further in view of the statement made by the respondents that in lieu of that plot,
[2025:RJ-JP:1525-DB] (2 of 2) [SAW-621/2024] another cultivable land in the same village ad-measuring 0.44 hectare, which is more than double of the earlier plot, has been allotted to the appellant, we are not inclined to interfere with the impugned order.
2. The appeal is, accordingly, dismissed. Pending application, if any, also stands dismissed.
3. We make it clear that the respondents shall proceed to hand over the possession of the alternate plot ad-measuring 0.44 hectare after passing necessary orders within a period of one week from the date the petitioner-appellant hands over the possession of the subject land ad-measuring 0.2 hectare.
