Heard the parties. The petitioners have been made accused in connection with Jamua P.S. Case No. 75 of 2024, S.T. Case No.336 of 2024, for the offences registered under Sections 341, 342, 323, 324, 325, 307 & 302 of the Indian Penal Code, pending in the court of learned Additional Sessions Judge-IX, Giridih. On 25.03.2024 at about 11:00 Noon, petitioners and co-accused persons are alleged to have assaulted the parents and grand-parents of the informant. The father of the informant namely Prakash Ray succumbed to his injuries. It was submitted that there is general and omnibus allegation against all the accused persons including the petitioners. It was further submitted that there is allegation against the accused persons to have assaulted Rina Devi but she has not sustained any injury. Mr. Vijoy Kumar Sinha, learned A.P.P on behalf of the State assisted by Mr. Arwind Kumar, learned counsel for the informant have opposed the
prayer for bail and submitted that the trial of the case is going on and five witnesses have been examined. It was further submitted that one witness namely Tarni Devi has stated that petitioners had assaulted the deceased. Considering the fact that during investigation, none of the witnesses have made any specific allegation against the petitioners, I am inclined to release the petitioners, on bail.
Accordingly, the petitioners, named above, are directed to be released on bail on furnishing bail bonds of Rs.20,000/- (Rupees Twenty Thousand) each with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-IX, Giridih, in connection with Jamua P.S. Case No. 75 of 2024, S.T. Case No.336 of 2024. (Ambuj Nath, J.) BS/-
