2I The case of the prosecution is that on o5.04.2025 at about ll.30 a.m, a joI'nt raid Was conducted by the officials of the Prohibition and Excise Department and the police Debartmen{ at a dilapida,ted house located on the southern side of Nampalli and Narasimpalli Diguva Tanda Villages perceived a strong pungent smell emanating from the premises. On inspection, several plastic vessels containing 90 liters of heavI'Iy fermented jiggery wash were found in the premises of the petI-{iOner and the same was seized. 3. Mr. Akurathi Rama Krishna, the learned counsel for the petitioner contends that the`petitioner is an innocent of the alleged offence and has been falsely implicated by the police. It is further submitted that the Petitioner iS the sole earning member of his famI|ly and, he iS ready tO abide any conditions that may be imposed by this court, and it is urged to grant -pre-arrest bail to the petitioner. 4. Per confra, Mr.Neelotpha] Garlji, +the learned Assistant Public Prosecutor vehemently opposed the grant of pre-arrest bail to the Petitioner, Submitting that the investigation is still underway and several +---. €r---:r\
material witnesses remain to be.examined. It is contended that if the petitioner is released on pre-arrest bail, there is a strong likelihood that he may abscond, thereby hampering the ongoing investigation and evading the process of law. 6. On perusal of the record, 90 liters offermented jiggery wash Were found in the abandoned house of the Petitioner. Since the said house 'is belongs to the Petitioner, he is shown as Accused in th-ls case. 7. Learned Assistant Public Prosecutor for the Respondent/ State submits that there are no adverse antecedents against the Petitioner so far. 8. Cons'Idering the gravity and nature Of the allegations leveled against the petitioner, this Court deems it fit to grant pre-arrest bail tO the f / petitioner. 9.
ln the result, the Criminal Petition is allowed with the following condit-Ions: i) In the event of his arrest, the Petitioner /Accused shall be enlarged on bail subject tO his executing a bond i-.--,I Qt I,I
