[2025:RJ-JP:38923] HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR S.B. Currently Residing As A Tenant In Chhotu Lal Narwal Ka Makan, Purane Railway Fatak Ke Samne, Nehru Nagar, Police Station Bheemganj Mandi, District Kota. (Confined In Central Jail, Kota). ----Petitioner Versus State Of Rajasthan, Through Pp ----Respondent For Petitioner(s) : Ms. Anushka Dikshit, Adv. For Respondent(s) : Mr. Vijay Singh Yadav, PP HON'BLE MR. JUSTICE PRAVEER BHATNAGAR Order 20/09/2025 1. The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.168/2024, registered at Police Station Bheemganj Mandi, District Kota City, for the offence(s) under Sections 103(1) of BNS. 2. Learned counsel for the petitioner submits that the accused- petitioner has falsely been implicated solely on the circumstantial evidence as there is no direct evidence that the petitioner caused any fatal injuries to the deceased, the material witnesses have already been examined and trial of the case may take considerable time, therefore, the bail application of the accused- petitioner may be allowed. [2025:RJ-JP:38923] (2 of 2) [CRLMB-10996/2025] 3. Learned Public Prosecutor has vehemently opposed the grant of bail application and contended that the petitioner has committed the murder of the deceased, who has sustained multiple injuries, including fractures at chest wall ribs, pleurae and on head. The deceased also sustained injuries at his ear along with several abrasions and bruises on his shoulder. The presence of the petitioner was found in the room with the deceased by the witnesses and they have deposed against the petitioner. It is also contended that material witness Sonia in her statement has also stated that some altercation took place between the deceased and the petitioner, thereafter, when she returned her home, she found deceased lying on the floor with multiple injuries, therefore, considering the above facts, the bail application of the accused- petitioner may be dismissed. 4. Heard and perused the material available on record. 5. It is not desirable to express anything on the merits of the case. Considering the statement of the material witnesses and nature of the offence, this Court is not inclined to enlarge the accused-petitioner on bail. 6. Accordingly, the instant bail application filed by the accused- petitioner is hereby dismissed. (PRAVEER BHATNAGAR),J Ashwani Kr Srivastava/-89
