This writ petition has been filed with the following prayer:- "1) Direct the Principal Judge Family Court, Etawah to decide the H.M.A. petition no. 79 of 2025 in between (Sachin Yadav Vs Soni Devi) under section 13(B) Hindu Marriage Act pending before Principal Judge Family Court Etawah since 01.02.2025, expeditiously as possible with a short and stipulated period and it is also further prayed that court may exempt the provision of second motion under section 13B ΗΜΑ." It is contended that the petitioner and respondent are married according to Hindu Rites and Customs on 24.04.2018. Due to matrimonial dispute, they have been living separately. An application under Section 13-B of the Hindu Marriage Act for the mutual divorce was filed on 01.02.2025. Thereafter, an application for waiving off cooling period, as provided under Section 13-B, was moved on 19.02.2025. The sole prayer made in the writ petition is for expeditious disposal of the said application. As no useful purpose would be served in keeping the matter pending, or calling for counter affidavit or issuing notice to the private respondents, the matter is being disposed of, at the admission stage, with a direction upon Principal Judge, Family Court, Etawah to proceed with the application dated 19.02.2025 and decide the same, after hearing all the concerned parties, strictly in accordance with law expeditiously preferably within a period of one month from the date of production of certified copy of this order, keeping in view the dictum of Hon'ble Apex Court rendered in case of Amardeep Singh Vs. Harveen Kaur, (2017) 8 SCC 746. With the aforesaid direction, present writ petition stands disposed of. It is made clear that this Court has not adjudicated the case on merit.
