Mr. Suresh Singh Saini, Advocate, for respondents No. 8, 10 to 13. CMP(M) Nos. 740 and 741 of 2026. Heard. The application bearing No. CMP(M) 740 of 2026 has been filed filed for bringing on record legal representatives of deceased respondent No.2 Smt. Khushvinder Kaur and CMP(M) No. 741 of 2026 has been filed for condonation of delay and also for setting aside the abatement, if any, in bringing on record her legal representatives. Deceased respondent No.2 Khushvinder Kaur is stated to have expired on 09.07.2013. As per the averments made in the application Shri Harpreet Singh is the sole legal
heir of the said respondent. The applications are duly
supported
by
afÏdavits
of
the competent/authorised ofÏcer of the applicants and the copy of death certificate of deceased respondent No.2 Smt. Khushvinder Kaur has also been appended with the application, which reveals that the said respondent has expired on 09.07.2013. It has been stated in the application for condonation of delay that they were not aware about the death of deceased respondent No.2 and it is only when report received by the Registry in the present case that respondent No.2 has expired, thereafter they came to know about the death of the said respondent and necessary steps have to be taken by them. Learned counsel for the respondents have no objection, in case the present applications are allowed. Consequently, in view of the averments made in the applications, which are duly supported by afÏdavits, the same are allowed. Accordingly, the delay in filing the application for bringing on record
the legal representative of deceased respondent No.2 is condoned and the proposed legal representative Shri Harpreet Singh is ordered to be brought on record as respondent No.2(a). Abatement, if any, is also ordered to be set aside. Amended memo of parties be filed within two weeks. Both the applications stand disposed of. CMP(M) No. 1764 of 2025. Issue notice to the newly added respondent No.2(a) Shri Harpreet Singh, returnable within four weeks, on steps being taken within one week.
It is contended by learned counsel for the respondents that as per the instructions, respondent No.3(c) Smt. Premi Devi wd/o late Shri Padam Dev has also expired during the pendency of the appeal. On the oral request of Mr. Baldev Singh Negi, learned Additional Advoate General, the name of respondent No.3 (c) Smt. Premi Devi is ordered to be deleted from the array of parties as her legal heirs
are already on record as respondents No.3(a), 3(b) and 3(d). Amended memo of parties be filed within three weeks from today. (Romesh Verma) Judge 15th May, 2026. (Jai)
