ORDER: The instant criminal petition under Section 482 of the Code of Criminal Procedure, 1973 (for short ‘Cr.P.C)/under Section 528 of BNSS, has been filed by the Petitioner/Accused, seeking quashment of the order dated 07.01.2022 passed by the learned Additional Junior Civil Judge, Chirala, Prakasam District in C.C.No.493 of 2013 issuing NBW against the petitioner/Accused.
2. Heard Sri Dr.Challa Srinivasa Reddy, learned counsel for the petitioner and Ms.K.Priyanka Lakshmi, learned Assistant Public Prosecutor representing on behalf of the State.

Learned counsel for the petitioner would submit that the petitioner herein filed Crl.P.No.1820 of 2016 seeking quashment of the case pending against the petitioner/accused in C.C.No.493 of 2013. The petitioner/accused also obtained stay in that matter vide Orders dated
15.02.2017.
Learned counsel for the petitioner would further submit that though the stay force, learned Magistrate issued Non-Bailable Warrant on 07.01.2022 and moving further to secure the presence of the petitioner before the Court.
Learned counsel for the petitioner would further submit that Crl.P.No.1820 of 2016 was dismissed for non-prosecution. As the Non-Bailable Warrant was in was
4 issued when the stay is in force, appropriate orders may be passed directing the learned Magistrate to consider the case of the petitioner.
4. Learned Assistant Public Prosecutor representing the State would submit that the Court may pass appropriate orders.
5. Considering the submissions, it is a case where Non-Bailable Warrant was issued against the petitioner to secure her presence before the Court. The record shows that it is an old matter in C.C.No.493 of 2013 for the offences punishable under Sections 120-B & 506 of IPC. In that view, it is apposite to dispose of the present petition directing the petitioner to appear before the Trial Court and move an appropriate application to recall the warrant. On filing such application, learned Magistrate is directed to look into the points raised, as to the issuance of warrant during the pendency of the said order passed by this Court and take appropriate decision according to law and dispose of the main case in C.C.No.493 of 2013 as expeditiously as possible without granting any further adjournments in a casual way by mere asking. Learned Magistrate is also further direction to take the fresh sureties from the petitioner to secure her presence before the Court for quick disposal of the matter. Learned Magistrate is further directed to report the progress of the case to the Registrar (Judicial) by 05.11.2025.
6. With these observations, the Criminal Petition is disposed of.
