The Second appeal and I.A.Nos.1 & 2 of 2025 coming this day for order as to settlement in the presence of Sri P Vivek, Advocate for the Appellant and of Sri Sambangi Mallikharjuna Rao, Advocate for Respondent, Appellant and the Respondent through their respective advocate having filed I.A.No.2 of 2025 requesting the court to pass decree in terms of Memorandum of Compromise entered into between them and upon perusing the grounds of appeal, Judgment and decree of the Trial Court and the Joint Memorandum of Compromise purporting to have been signed by the parties and their advocates and filed with the said I.A.No.2 of 2025 and is appearing from the said Memorandum of compromise that the parties herein have entered into compromise and settled the matter in terms of compromise filed in IA.No.2 of 2025. That the terms of the Memorandum of Compromise entered into between the appellant and respondent herein are i. That both the parties amicably resolved their disputes in full and final settlement. In pursuance of the said settlement, the respondent executed a registered sale deed dated 25-11-2024 bearing Document No. 51650/2024 in favor of the appellant for a consideration of Rs.1,61,000/-(Rupees One lakh Sixty- One Thousand Only). Copy of the registered sale deed dated 25-11-2024 is annexed along with this petition, ii. That the Schedule of the property is extracted herein below:- Kakinada District, Kakinada Urban Mandal, Kakinada Sub Registrar office, within the limits of Kakinada Municipal Corporation, Ward No. 28, Block No. 48, T.S No. 1849/1, Property is vacant site situated on the western side of house bearing D.No. 48-4-74, admeasuring 23 Sq. yds. or 19.23 sq. meteres, within the limits of Gogudanayyapeta, Jagannadhapuram, Kakinada. The boundaries of schedule property are as follows: - East; 13.3 ft. or 4.03 meters. Land belonging to you. West; 13.3 ft. or 4.03 meters. Wall belonging to Gollilu North :15.8 ft. or 4.77 meters Joint lane way. (Usage of this joint lane is restricted only to you and Konada Paidamma) South: 15.8 ft. or 4.77 meters land belonging to Koviri Venkata Ramya sri. The Vacant Land in between the following boundaries admeasuring 23 sq. yds. or 19.23 sq.meters. The land is sold to you and possession is being handed over to you today including all ways/routes in the land, water resources/water channel, all the easementary and all other rights, iii. That the respondent herein hereby agrees, accepts and undertakes to give up all her rights, title, claims and interest or whatsoever in the above schedule as she executed a registered sale document dated 25-11-2024 in full and final settlement of all her claims in the suits and received the sale consideration, iv. That the respondent hereby agrees, accepts and undertakes to give up ail her rights, in favor of appellant and shall not claim any right, title or whatsoever including any claim for easementary rights in respect of schedule property and also intends to withdraw OS No. 339/1992 on the file of Principal Junior Civil Judge, Kakinada. V. That the respondent hereby agrees, accepts and undertakes that she or her legal heirs shall not interfere or claim any right or whatsoever with respect to the schedule in OS No. 219/1992 and 339/1992 on the file of Principal Junior Civil Judge, Kakinada and shall not claim any ownership, joint ownership or any kind of easementary rights, vi. That both parties mutually executed a registered sale deed dated 25-11-2024 and respondent has relinquished all her rights and ownership which she previously claimed as per the plaint schedule in OS No. 339/1992. Copy of the registered sale deed is annexed by treating it as part and parcel of this memorandum of this compromise for all purposes to avoid any eventuality in future, vii. That both appellant and respondent mutually and jointly hereby agree, accept and undertake that this compromise is good for both the Second Appeals i.e., SA No. 1094 of 2003 and SA No. 1180 of 2003 on the file of this Hon'ble Court and they be allowed.
