Petitioner has been made an accused in connection with POCSO Case No. 101/2024, arising out of Kandi P.S. Case No. 69/2024 for the offence under sections, 137(2), 87, 77, 65(1) of Bhartiya Nyaya Sanhita, 2023 and Sections 4, 8 of the POCSO Act, pending in the court of the learned Special Judge, POCSO Act, Garhwa. It is alleged that the petitioner had enticed away the daughter of the victim to leave her lawful guardianship. The victim is still missing. From the perusal of the statement of the witnesses recorded in the case diary, it appears that some of the witnesses had stated that they have seen the victim going towards Korgai More and subsequently, she went missing. Learned lawyer for the petitioner submitted that the petitioner has been made an accused only on the basis of suspicion. It was further submitted that it is not even a case of the victim to be last seen with the petitioner. Regard being had to the facts and circumstance of the case, the petitioner named above, is directed to be released on bail on furnishing bail bond of Rs. 20,000/- (Twenty Thousand only) with two sureties of the like amount each to the satisfaction of learned Special Judge, POCSO Act, Garhwa in connection with POCSO Case No. 101/2024, arising out of Kandi P.S.
