To issue a writ order or direction in the nature of Mandamus directing the Assistant Record Officer Gorakhpur, respondent No.2 to decide the case No.205 of 2022 computer case No. D202205310000205 filed under Section 49 of U.P. Revenue Code, 2006 (Chandrabhan and others vs. Nagendra and others) at the earliest opportunity." 3. Learned counsel for the petitioner submitted that proceeding under Section 49 of U.P. Revenue Code, 2006 is pending before respondent No.2/Assistant Record Officer, Gorakhpur since 02.11.2022. He further placed certified copy of the order sheet of the pending proceeding, which has been annexed as Annexure No.2 to the writ petition in order to demonstrate that the case is not proceeding expeditiously. 4. Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to respondent No..2/ Assistant Record Officer, Gorakhpur to consider and decide the aforementioned proceeding in accordance with law expeditiously and preferably within a period of three months from the date of production of certified copy of this order after giving opportunity of hearing to the parties concerned and without granting unnecessary adjournments to either of the parties.
