By means of present petition filed under Article 226 of the Constitution, petitioner has prayed for a writ of mandamus commanding respondent no. 2 and 3 to grant petitioner further six months' time for physical eligibility test on the ground that he had met an accident just before the examination and in which he suffered fracture on his left leg and underwent surgery. Petitioner claims that after the document verification and physical test that was held on 31.1.2025 petitioner was declared fit and was to appear in physical eligibility test on 25.2.2025 but he met an accident on 28.12.2024 and resultant surgery in his leg for which he was advised bed rest upto 26.2.2025. He was further advised best rest on 15.2.2025 for a further period of 60 days. Under the circumstances he missed opportunity to appear for physical eligibility test. Learned Standing Counsel on the contrary submits that there is no such rule to grant relaxation to such candidates, however, he states that direction may be issued to the competent authority to consider the claim of the petitioner in accordance with law. In such above view of the matter, I hereby direct petitioner to apply before the Chairman, U.P-. Police Recruitment and Promotional Board, Lucknow annexing therewith all medical papers including surgery papers within a period of two weeks from today and in the event he makes an application, the Chairman, U.P-. Police Recruitment and Promotional Board, Lucknow shall be considering the same granting sympathetic consideration looking to such facts of the case. A mere denial of physical standard test for unavoidable reasons like accident etc. may cause serious prejudice to the meritorious candidates. The appropriate decision shall be taken by the Chairman, U.P-. Police Recruitment and Promotional Board, Lucknow within a further period of two weeks on the application to be presented by the petitioner.
