Petitioners/Accused No.2 & 3 AND The State of Andhra Pradesh, Rep., by its Public Prosecutor, High Court of Judicature at Amaravathi. Respondent Petition under Section 480 & 483 of BNSS., is filed praying that in the circumstances stated in the grounds filed in support of the petition, the High Court may be pleased to enlarge the petitioners on bail in Crime No. 83 of 2025 on the file of the Talla Proddatur Police Station, Tallaproddatur, YSR Kadapa District, in the interest of justice. The petition coming on for hearing, upon perusing the Petition and the affidavit filed in support thereof and upon hearing the arguments of Sri. P V N KIRAN KUMAR Advocate for the Petitioners and of PUBLIC PROSECUTOR for the Respondent; The Court made the following ORDER:
2 The Court made the following ORDER: The Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the petitioners/Accused Nos.2 and 3 on bail in Crime No.83 of 2025 of Tallaproddatur Police Station, Tallaproddatur, YSR Kadapa District registered against the petitioners/Accused Nos.2 and 3 herein for the offence punishable under Sections 329(3), 324(4), 308(5) read with Section 3(5) of Bharatiya Nyaya Sanhita, 2023 (for short ‘the BNS’). 2. As seen from the record, the .petitioners herein demanded the de facto complainant for an amount of Rs.2,000/-, but he refused to pay it, the petitioners herein along with A-1 trespassed into the mosambi orchid of the de facto complainant and indiscriminately cut 41 mosambi trees and caused loss to the de facto complainant and also threaten him with dire consequences. The petitioners herein were arrested on 07.06.2025 and ever since they have been in judicial custody. Mr.P V N Kiran Kumar, learned counsel for the petitioner submits that the petitioners have not committed any offence and they were falsely implicated by the police in the crime; The petitioners would abide by any conditions to be imposed by this Court.
This court granted bail to Accused No.1 in Crl.P.No.7592 of 2025 on 28.07.2025. The Petitioners have got fixed abode, hence, if any condition is imposed while granting the bail. Petitioners would not violate it; and it is urged to allow the petition. 3. 4. Per contra, Ms.P.Akhila Naidu, learned Assistant Public Prosecutor, submits that there are three adverse antecedents against the petitioner
3 No. 1/Accused No.2 and one adverse antecedent against the petitioner No.2/Accused No.3 and it is urged to dismiss the bail petition. 5. This Court dismissed the bail application filed by the petitioners who Accused Nos.2 and 3 in Crl.P.No.7592 of 2025 on 28.07.2025 on the ground that there are adverse antecedents against the petitioners material portion of the investigation was not completed while enlarging the petitioners therein on bail considering the severity of the allegations levelled against the petitioners herein. There are changed circumstances from the date of dismissing the earlier application from the date of filing the present application. The Investigating Officer after completion of investigation filed charge sheet on 11.08.2025. The petitioners were arrested on 07.06.2025 and since then they have been in the judicial custody. 6. Considering the changed circumstances and the period of detention undergone by the petitioners, this Court is inclined to enlarge the petitioners on bail with the following stringent conditions: are and also the i. The petitioners/Accused Nos.2 and 3 shall be enlarged on bail subject to them executing a bond for a sum of Rs.10,000/- (Rupees Ten thousand only), each with two sureties each for the like sum each to the satisfaction of the learned Additional Judicial Magistrate of First Class, Jammalamadugu. ii. The petitioners/Accused Nos.2 and 3 shall appear before the Station House Officer, Tallaproddature Police Station YSR
4 Kadapa District, on every Saturday in between 10:00 am and 05:00 pm, till cognizance is taken by the learned the Trial Court, iii. The petitioners/Accused Nos.2 and 3 shall not leave the limits of the District without prior permission from the Station House Officer concerned.
The petitioners/Accused Nos.2 and 3 shall not commit indulge in commission of any offence in future. V. The petitioners/Accused Nos.2 and 3 shall cooperate with , the investigating officer in further investigation of the case and shall make himself available for interrogation by the investigating officer as and when required. Vi. The petitioners/Accused Nos.2 and 3 shall not, directly indirectly, make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him/her from disclosing such facts to the court or to any police officer, vii. The petitioners/Accused Nos.2 and 3 shall surrender their passports, if any, to the investigating officer. If they claim that they do not have passports, they shall submit an affidavit to that effect to the Investigating Officer. Accordingly, the Criminal Petition is allowed. IV. or or
