Nanda, Advocate For the State : Mr. Rakesh Kr. Sinha, A.P.P. -------- 04/ Dated 21.02.2025 Heard the parties. The petitioner has been made accused in connection with Simdega Muffasil P.S. Case No. 06 of 2024, corresponding to Special POCSO Case No.19 of 2024, for the offence registered under Section 376-D of the Indian Penal Code and Sections 4 & 8 of POCSO Act, 2012, pending in the court of learned Additional Sessions Judge-I-cum-Special Judge, POCSO Act, Simdega. On 17.06.2024, petitioner alongwith co-accused persons are alleged to have raped two victims near Banbira forest area. It was submitted that petitioner is not named in the F.I.R and his name has transpired in the confession of co-accused. Attention has been drawn towards statements of both the victims recorded during trial, in which, they have not identified the petitioner in the dock as one of the rapists. Considering the aforesaid fact, I am inclined to release the petitioner, on bail. Accordingly, the petitioner, named above, is directed to be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each, to the satisfaction of learned Additional Sessions Judge-I-cum-Special Judge, POCSO Act, Simdega, in connection with Simdega Muffasil P.S. Case No. 06 of 2024, corresponding to Special POCSO Case No.19 of 2024. (Ambuj Nath, J.) BS/-
