Heard Mr. N. Jotendro, learned sr. counsel assisted by Md. Murtaza Ahmed, learned counsel for the petitioner and Mr. L. Jeson, learned counsel for the respondent no. 1 and Mrs. Ch. Sundari, learned GA for the State respondent nos. 2, 3 & 4. [2]
The petitioner who is the village Headman of K. Ashang Khullen Aze (KAKA), Kasom Khullen Sub-Division, Kamjong District, Manipur approached this Court for a direction to the respondent not to shift the proposed integrated check post/ border hut at KAKA to any other place. [3]
It is stated that the petitioner has donated an area of 200 acres of land to the respondents for development of the integrated chek post/ border hut. However, the Govt. is trying to shift and establish to other place. [4]
In this regard, a lease agreement dated 16.10.2023 was executed between the petitioner and the Deputy Commissioner, Kamjong regarding donation of the land for the development and establishment of model town at KAKA. [5]
The petitioner has submitted a representation dated 05.09.2025 to the Additional Secretary (TC & I), Govt. of Manipur requesting for OINAM THOIBA MEITEI Digitally signed by OINAM THOIBA MEITEI Date: 2025.10.06 12:47:25 +05'30'
implementation of the integrated check post/ border hut at KAKA under Kamjong District, Manipur and the same may not be shifted to Namlee which is one of the Hemlet of KAKA and the representation is pending with the authority. [6]
The learned sr. counsel for the petitioner submits that the writ petition may be disposed of by directing the respondent no. 3 to consider and pass an speaking order to the pending representation dated 05.09.2025 submitted by the petitioner. [7]
Mr. L. Jeson, learned counsel for the respondent no. 1 and Mrs. Ch. Sundari, learned GA for the State respondents have no objection in disposing the present writ petition by passing innocuous order. [8]
However, Mr. N. Jotendro, learned sr. counsel for the petitioner submits that in order to avoid any complicacy, status quo as on date shall be maintained till the representation is disposed of. [9]
Mrs. Ch.
Sundari, learned GA for the State respondents submits that lease agreement executed between the petitioner and DC, Kamjong dated 16.10.2023 is only for development of model town at KAKA and the development of integrated check post/ border hut is not mentioned in the lease agreement and the status quo order may not be appropriate in this situation. [10]
This Court has perused the materials on record and heard the
submissions made by the parties. [11]
The present W.P. (C) No. 788 of 2025 is disposed of by directing the respondent no. 3 to dispose of the representation dated 05.09.2025 submitted by the petitioner by passing an speaking order as per rule within a period of 2(two) week’s from the date of receipt of a copy of this order. [12]
Till the disposal of the representation dated 05.09.2025, any decision for shifting of place shall not be passed. [13]
The MC(W.P. (C)) No. 726 of 2025 is also disposed of accordingly.

Registry is directed to send a copy of this order to the respondent no. 3 i.e. Additional Secretary (TC & I), Govt. of Manipur for information and necessary compliance.
