(ORAL) The instant petition has been filed under Section 482 of BNSS, 2023 for grant of anticipatory bail to the petitioner in case FIR No. 29.08.2020, under Sections 420, 406, 120 , registered at Police Station NRI, District On 25.02.2025, the petitioner had been granted interim anticipatory bail with direction to join investigation and the relevant part of the said order reads as under: -
“Learned counsel for the petitioner, inter alia, contends that when the complaint was initially made, a detailed enquiry was carried out, however, no wrongdoing was found on the part of the petitioner. It is 04 years thereafter, the police was attempting to arrest him without there being any material change in circumstances. Learned State counsel, on instructions, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. He, on further instructions, submits that the petitioner is not required for further investigation, much less for his custodial interrogation. In view of the above, the petition is allowed, and interim order dated 25.02.2025, is made absolute subject to the conditions l Section 438(2) Cr.P.C./482(2) BNSS.
